Facing bankruptcy is already stressful. Having to take time off work, find childcare, arrange transportation, or sit in a waiting room adds unnecessary burden. Merna Law’s virtual filing program removes every logistical barrier between you and a fresh financial start. We serve clients across Hampton Roads, Richmond, the Northern Neck, the Eastern Shore, and throughout the Eastern District of Virginia.

Need Emergency or Same-Day Bankruptcy Filing?

Facing a Foreclosure Sale or Garnishment This Week?

If a foreclosure sale, wage garnishment, or repossession is happening in the next few days, Merna Law can often prepare and file an emergency “skeleton” petition the same day or next business day. Filing just the voluntary petition, your creditor list, and a few required forms triggers the automatic stay immediately — the same legal protection as a full filing — while you complete the remaining schedules within the 14 days the court allows under Federal Rule of Bankruptcy Procedure 1007(c). Call now if your situation is urgent; we will tell you honestly whether a same-day emergency filing is the right move for you.

How the Virtual Process Works — Step by Step

1

Free Phone Consultation

A licensed Virginia bankruptcy attorney reviews your situation by phone and recommends the right chapter. No obligation, no office visit required.

2

Document Collection

You upload documents through our secure Client Services Portal from your phone, tablet, or computer.

3

Petition Preparation

We prepare your petition and return it for your electronic review and e-signature. No printing, no faxing, no driving.

4

Filing & Automatic Stay

We file electronically with the EDVA Bankruptcy Court. The automatic stay activates immediately, stopping garnishments, foreclosure, and collection calls.

5

341 Meeting by Phone or Zoom

The 341 Meeting is conducted remotely. You participate from home. Your attorney prepares you and is present during the hearing.

6

Discharge & Fresh Start

Your discharge order is delivered electronically. Case complete — without a single in-person visit.

The Four Pillars of Our Virtual Program

Free Telephone Consultation

Every client relationship begins with a free phone call with a licensed Virginia bankruptcy attorney — not a paralegal or intake coordinator. You speak directly with the attorney who will handle your case. We review your income, debts, assets, and goals and give you an honest assessment of whether bankruptcy makes sense, which chapter fits, and what the process looks like. The call typically takes 15–20 minutes.

All subsequent communication — questions, updates, strategy — happens by phone or secure message through the Client Services Portal. You always have a direct line to your attorney.

Virtual Document Delivery and Review

Bankruptcy requires financial documents: recent pay stubs, two years of tax returns, bank statements, a creditor list, and property information. In our virtual program, every document is handled through our secure online portal. No trips to the office, no fax machines, no physical mail.

You receive a personalized document checklist. Documents are uploaded from your phone camera, scanner app, or computer. Our team reviews each document as it arrives and notifies you of anything missing. Once complete, your petition is prepared and returned to you with plain-English annotations explaining each section. You review, ask questions, and sign electronically.

Client Services Portal

The Merna Law Client Services Portal is the hub of your virtual filing experience. Your secure private dashboard lets you:

  • Upload required documents from any device, any time
  • View the real-time status of your case
  • Review and sign documents electronically
  • Send and receive secure messages to your attorney and case advisor
  • Track upcoming deadlines and hearing dates
  • Access your petition and all supporting documents
  • Complete required credit counseling and debtor education through court-approved online providers

The portal is available 24/7 from any internet-connected device. You are never waiting for office hours to check on your case or submit a document.

All documents are encrypted in transit and at rest. Attorney-client privilege applies to all communications. Your information is never shared with third parties.

Zoom 341 Meeting of Creditors

The 341 Meeting of Creditors is a required proceeding held approximately 21–40 days after your petition is filed. In the Eastern District of Virginia, 341 Meetings are conducted remotely by phone or Zoom for most Chapter 7 and Chapter 13 consumer cases. You do not go to the courthouse — you participate from home.

Before the meeting, your Merna Law attorney conducts a preparation session with you. We walk through every question the trustee is likely to ask, review your petition together, and make sure you are comfortable. Your attorney participates remotely alongside you during the hearing.

What Happens at the 341 Meeting

The trustee confirms your identity and asks you to swear that your petition is accurate. Common questions cover your address, whether all assets and debts are listed, and whether you reviewed the petition before signing. In most consumer cases, no creditors appear. The trustee calls the meeting, asks questions, and adjourns — usually in under 15 minutes.

In Chapter 13 cases, there may be a plan confirmation hearing before the bankruptcy judge. This also takes place remotely in most EDVA cases. Your Merna Law attorney handles all court appearances on your behalf.

What You Need to Get Started

You do not need to gather all your documents before calling. Your initial consultation requires nothing more than a willingness to discuss your situation. Most clients need:

  • Pay stubs or proof of income for the past six months
  • Federal tax returns for the past two years
  • Bank statements for the past three to six months
  • A list of debts with approximate balances
  • Information about property you own (home, vehicles, retirement accounts)
  • Your Social Security number (for the credit counseling course and petition)

Many documents can be retrieved electronically. We help you obtain anything you are missing.

Who Is the Virtual Program Right For?

The program is especially valuable for:

  • Clients in rural areas of the Eastern District — Northumberland, Westmoreland, King George, Mathews, Accomack, Northampton, and other counties far from our offices
  • Working clients who cannot take time off during business hours
  • Clients with transportation challenges — no vehicle, no license, or mobility limitations
  • Parents of young children who cannot arrange childcare for multiple office visits
  • Active duty military and their spouses stationed away from our offices
  • Anyone who values privacy and prefers handling sensitive financial matters without visiting a law office

Frequently Asked Questions

Do I ever have to come to your office?

No. Every step — consultation, document gathering, petition signing, 341 Meeting, and discharge — is available remotely. In-person visits to our Virginia Beach, Newport News, or Richmond offices are welcome but never required.

Is the virtual process as secure as in-person?

Yes. All documents are transmitted through our encrypted Client Services Portal. Electronic signatures are legally valid under the ESIGN Act and Virginia law. Attorney-client privilege applies to all communications.

What if I am not comfortable with technology?

Our staff walks you through every step. Most of the process can be completed on a smartphone. We have helped clients of all ages and technology comfort levels complete bankruptcy entirely by phone and portal.

Can I file virtually if I live far from your offices?

Yes. Merna Law serves clients throughout the entire Eastern District of Virginia — all four divisions. A client in Accomack County or Mecklenburg County receives the same full legal representation as a client in Virginia Beach.

How long does the virtual process take compared to in-person?

The timeline is identical. Chapter 7 cases are discharged in the same 4–6 months. Chapter 13 cases follow the same 3–5 year plan. Virtual filing does not slow down your case.

Can I file bankruptcy the same day to stop a foreclosure sale or garnishment?

Often, yes. In a true emergency, we can file an emergency (or “skeleton”) petition containing just the essential forms, which triggers the automatic stay immediately and halts most foreclosure sales, garnishments, and repossessions the same day. The rest of your schedules are then due within 14 days. Call as soon as you know a sale or garnishment date — the sooner we know, the more options we have.

What about the required credit counseling courses?

Both required courses are available online through court-approved providers. Most clients complete each in one to two hours from home.
